This website www.actuaries.org.uk (the “website”) is provided by the Institute and Faculty of Actuaries (the “IFoA”). Please read these Terms and Conditions (the “terms”) carefully before using our website. 

These terms apply to all pages, documents and other content hosted on the website including the IFoA Member Portal, the IFoA Virtual Learning Environment (“VLE”), IFoA Communities (“Communities”) and IFoA Blogs.

“Our” or “we” or “us” in these terms means the IFoA or any of its subsidiaries or joint ventures.

“You” or “your” in these terms means any user accessing the website.

1. Acceptance

By using our site, you indicate that you accept:

  • These terms and you agree to abide by them.  If you do not agree, please refrain from using our website; and
  • All proprietary rights in the material displayed and/or received are the property of the IFoA.

2. Accessing our website

Access to our website is permitted free of charge on a temporary basis and, notwithstanding our Accessibility Statement, we may suspend access, amend the website or close it indefinitely without notice.

We aim to update our website regularly and may change the material on it from time to time. Any of the material on our website may be out of date at any given time, and we are under no obligation to update it.

We restrict access to some parts of our website to our members or non-member service users who have registered with us.
If you choose, or you are provided with, a password or any other information as part of our security procedures, you must treat such information as confidential and you must not disclose it to any third party.

We reserve the right to disable any password, whether chosen by you or allocated by us, at any time, if in our opinion you have failed to comply with these terms.

3. Limitations on use

We are the owner or the licensee of all intellectual property rights in our website, and in the material published on it. All rights are reserved.

Material on this website may be reproduced free of charge in any format or medium, providing it is:

  • Not modified in any way;
  • Not used out of context;
  • Acknowledged as the IFoA’s or its relevant subsidiary’s copyright and the source is quoted; and
  • Used solely for your personal reference or non-commercial internal reference within your company or organisation.

You must not use any illustrations, photographs, video or audio sequences or any graphics separately from any accompanying text.
Our status (and that of any identified contributors) as the authors of material on our website must always be acknowledged and all relevant copyright laws abided by.

You must not use any part of the materials on our website for commercial purposes without obtaining permission to do so from us or our licensors (with our prior consent).

If you print off, copy or download any part of our website in breach of these terms, your right (if any) to use our website will cease immediately and you must destroy any copies of the materials you have made.

4. Website content for general information only

The materials displayed and/or posted on our website are not intended to amount to advice on which reliance should be placed. We therefore disclaim all liability and responsibility arising from any reliance placed on such materials by any visitor to our website, or by anyone who may be informed of any of their content.

5. Information about you and your visits to our website

We process information about you in accordance with our privacy notice including the placing of Cookies for analytical purposes or to enable website functionality.  You may opt out of the placing of Cookies for analytical purposes, contact the Data Protection Officer at data.protection@actuaries.org.uk for further information. 

6. Uploading material

Any material you upload to our website will be considered non-confidential and non-proprietary, and we have the right to use, copy, distribute and disclose to third parties any such material for any purpose. We also have the right to disclose your identity to any third party who is claiming that any material posted or uploaded by you to our website constitutes a violation of their intellectual property rights.

We will not be responsible, or liable to any third party, for the content or accuracy of any materials posted by you or any other user of our website.  

We reserve the right to remove any material or posting you make on our website.

7. User generated content

The IFoA encourages the use of this website for professional networking. Users of our Communities site and VLE must communicate and interact online with appropriate professionalism, discretion and courtesy and in accordance with the IFoA Communities Rules and Guidelines and the guidance on Contributing to Forums

The IFoA is not responsible for any user generated content including user comments, content on discussion forums, posted images and/or documents uploaded by website users. In particular, without limitation, the IFoA has no responsibility for any advice or information posted by any user or for any reliance placed on that advice or information. 

Users shall not upload, transmit, distribute or otherwise publish on this website any materials which:

  • libels, defames, or is obscene, pornographic, abusive or threatening; or
  • infringes the intellectual property rights of any other person including (without limitation) infringing any person's copyright or trademark; or
  • is illegal; or
  • advocates, promotes or incites any illegal activity; or
  • advertises or solicits funds or is a solicitation for or offer to supply goods or services unless approved by us.

The IFoA reserves the right to exclude from using this site any person whom we consider to be in breach of any of these terms.

8. Misuse of website

You must not misuse our website. Misuse includes introducing material which is malicious or technologically harmful. You must not attempt to gain unauthorised access to our website, the server on which our website is stored or any server, computer or database connected to our website. You must not attack our website via a denial-of-service attack or a distributed denial-of service attack.  The extraction of website content or other interrogation of the website via the use of automated scripts (‘web scraping’) is not permitted and is a violation of the terms.

Where there is a breach of these terms that we believe may constitute a criminal offence under the Computer Misuse Act 1990, the UK Data Protection Act 2018 or any other relevant law we will report this to the UK police and/or equivalent law enforcement agencies overseas as required. We will co-operate with these authorities by disclosing your identity and any other relevant information about you to them. In the event of such a breach, your right to use our website will cease immediately.

9. Links to our website

If you link to our website you must only do so in a way that is fair and legal and does not damage our reputation or take advantage of it

You must not establish a link in such a way as to suggest any form of association, approval or endorsement on our part where none exists.

10. Links from our website

Links on our website to other websites and resources hosted by third parties are provided for your information only.  We have no control over the contents of those websites and/or resources and accept no responsibility for them or for any loss or damage that may arise from your use of them.

11. Limitations on liability

The material displayed on our website is provided without any guarantees, conditions or warranties as to its accuracy. 

To the extent permitted by law, we, other members of our group of companies and third parties connected to us hereby expressly exclude:

  • All conditions, warranties and other terms which might otherwise be implied by statute, common law or the law of equity.
  • Any liability for any direct, indirect or consequential loss or damage incurred by any user in connection with our website or in connection with the use, inability to use, or results of the use of our website, any websites linked to it and any materials posted on it, including, without limitation any liability for:
  1. Loss of income or revenue;
  2. Loss of business;
  3. Loss of opportunity;
  4. Loss of profits or contracts;
  5. Loss of anticipated savings;
  6. Loss of data;
  7. Loss of goodwill;
  8. Wasted management or office time; and;
  9. For any other loss or damage of any kind, however arising and whether caused by tort (including negligence), breach of contract or otherwise, even if foreseeable, provided that this condition shall not prevent claims for loss of or damage to your tangible property or any other claims for direct financial loss that are not excluded by any of the categories set out above.

This does not affect our liability for death or personal injury arising from our negligence, nor our liability for fraudulent misrepresentation or misrepresentation as to a fundamental matter, nor any other liability which cannot be excluded or limited under applicable law.

We will not be liable if, for any reason, our website is unavailable at any time or for any period.

We will not be liable for any loss or damage caused by a distributed denial-of-service attack, viruses or other technologically harmful material that may infect your computer equipment, computer programs, data or other proprietary material due to your use of our website or to your downloading of any material posted on it, or on any website linked to it.

12. Jurisdiction and applicable law

The English courts will have exclusive jurisdiction over any claim arising from, or related to, a visit to our website although we retain the right to bring proceedings against you for breach of these conditions in your country of residence or any other relevant country.

These terms and any dispute or claim arising out of or in connection with them or their subject matter or formation (including non-contractual disputes or claims) shall be governed by and construed in accordance with the law of England and Wales.

We may revise these terms at any time by amending this page. You are expected to check this page from time to time to take notice of any changes we make, as they are binding on you. Some of the provisions contained in these terms may also be superseded by provisions or notices published elsewhere on our website.
